Richard Childress Racing announced their decision to appeal the penalty Monday (April 21), with the panel’s decision dropping on Wednesday (April 23).

Love, whose No. 2 Chevrolet initially crossed the Start/Finish Line first Saturday (April 19), was disqualified later in the day for violating NASCAR’s rules regarding an infraction with the rear suspension.

โ€œThe panel finds that it is more likely than not that there was a violation of 14.14.2 Rear Suspension, I-5.H,โ€ the panel said in a statement. โ€œThe panel was unable to determine whether the violation was intentional or unintentional.

โ€œThe panel finds that the mating surfaces between the truck trailing arm and the U-bolt saddle were not in contact with each other.โ€

Sammy Smith, who initially finished second, was declared the race winner.

โ€œ”RCR is disappointed in NASCAR’s decision today to uphold the disqualification of the No. 2 team,โ€ Richard Childress Racing said in a statement. โ€œWe will focus our efforts on moving forward and being competitive at Talladega this weekend.โ€
