NASCAR plans to issue charter to ‘interested team’ amid 23XI-Front Row lawsuit

CHARLOTTE, N.C. — NASCAR plans to issue a charter to “an interested team”, according to a filing in their lawsuit with 23XI Racing and Front Row Motorsports.

NASCAR filed the document with the court Monday. They plan to issue the charter once the court rules on an injunction 23XI and FRM are seeking.

The teams are seeking an injunction to let their cars compete as chartered entries in the NASCAR Cup Series. Competing chartered would let them be locked into every race and earn more money than open teams.

Before the season began, a judge granted that request based on evidence at the time. In June, another judge overturned the decision. Almost immediately afterward, the teams filed for a new injunction. NASCAR promised to not doing anything with their charters until the ruling on the new injunction. However, the teams began racing as open entries in July at Dover Motor Speedway with a new rule that would — as it’s written — help the teams lock into each race.

In its filing Monday, NASCAR considered the four 23XI Racing- and Front Row Motorsports-owned charters to be “non-issued”. They also considered the two charters Stewart-Haas Racing sold — one each — to 23XI and FRM to be “inactive”.

A hearing on the new injunction request is scheduled for Thursday. A ruling could come any time after then but is likely to come the following week, leading up to the Sept. 5-7 race weekend at World Wide Technology Raceway.
