23XI and FRM intend to appeal ruling on injunction

CHARLOTTE, N.C. — 23XI Racing and Front Row Motorsports intend to appeal a judge’s ruling on an injunction they sought for competing in the NASCAR Cup Series in 2025.
On behalf of the teams, attorney Jeffrey Kessler stated they intend to appeal the denial. Kessler stated the denial “has no bearing on the merits of our case” and that they are pleased with the court fast-tracking the case.
Attorney Jeffrey Kessler stated that the teams will move forward to race in 2025 and continue to “fight for a more fair and equitable system in NASCAR that complies with antitrust law.”
A federal judge denied an injunction that would’ve allowed the two organizations to compete under the 2025 Charter Agreement without being bound to a clause allegedly preventing them from engaging in antitrust litigation against NASCAR. The judge ruled the teams didn’t meet their burden of proof.
